San Francisco Receives State Warning Over Delayed Housing Policy Reforms

San Francisco, the vibrant city known for its iconic Golden Gate Bridge and steep rolling hills, is now under the spotlight for a different reason - its housing policy. The city has been given a stern warning by the state of California to streamline its housing development process by December 28, or face potential consequences.

Missed Deadlines and State Intervention

The California Department of Housing and Community Development (HCD) had previously set a November 25 deadline for San Francisco to make necessary changes to its permitting process. This deadline was determined following a comprehensive state-funded review of the city's housing practices, known as the San Francisco Housing Policy and Practice Review. However, the city failed to meet this deadline, prompting the state to issue a final warning with a December deadline.

The Housing For All Plan

Since April, Mayor London Breed, along with Supervisors Joel Engardio and Matt Dorsey, have been working diligently to meet the new obligations outlined in their Housing For All plan. This plan, presented as the Constraints Reduction Ordinance, aims to streamline the city's housing development process. However, the state has threatened punitive action if the proposed changes are not implemented in time.

Proposed Changes and Controversies

The proposed changes include the elimination of Planning Commission hearings for code-compliant housing development in certain areas and the removal of certain terms used in local reviews. These changes have sparked debate among city officials, with some questioning the elimination of developer fees on certain affordable housing projects. The state, however, insists on the removal of the supervisors' amendments and demands no new amendments without their prior approval.

Potential Consequences of Non-Compliance

If San Francisco fails to comply with the state's demands, it could face severe consequences. These could range from the withholding of affordable housing and infrastructure grants to monthly fines of $10,000 to $100,000 or more. The state has even suggested a potential lawsuit against the city.

In a recent meeting, supervisors forwarded a resolution to request an extension of the HCD deadline and asked the state to revise the new requirements.
