A long-standing foreclosure saga has culminated in Fortress Investment Group's acquisition of the Bushwick Generator site from Toby Moskovits' Heritage Equity Partners

How the conflict was resolved: The Brooklyn property, located at 215 Moore Street, changed hands for $25.5 million. This transfer of ownership stems from a foreclosure process initiated by Fortress against Heritage in 2019, effectively concluding a four-year legal battle.

A limited liability company affiliated with Fortress successfully acquired the site at the beginning of the month, shortly after submitting a credit bid during a foreclosure auction. At the time of the sale, Heritage owed $53 million to Fortress, which had acquired the construction loan from Axos Bank in 2019. Even after the sale, Fortress is still owed $27.5 million.

How the litigation started, in a nutshell: The complex legal dispute had its origins in a mortgage taken out by Toby Moskovits and her partner, Michael Lichtenstein, in 2018, totaling $48.2 million, with an additional $4 million in interest accrued over five months in 2022, according to a referee's report from mid-January.

After Fortress filed for foreclosure in 2019, Moskovits contested the action, alleging that the lender was involved in a loan-to-own scheme. She claimed that Fortress had hindered her efforts to refinance the debt and discouraged other lenders from getting involved. However, the court ruled against her, asserting that there was "no dispute" regarding Moskovits' failure to meet her debt obligations.

The vision before the legal dispute: Heritage Equity Partners had ambitious plans for the Bushwick Generator site, envisioning a 13-story, 375,000-square-foot property designed to house a mix of office and retail space. The intended tenants for this development were startups in the blockchain, agriculture, and gaming industries, signifying a forward-looking and innovative approach to real estate in the Brooklyn neighborhood.
